These Data Services Terms apply when a customer uses REI Vantage Data Services. Data Services include property search and list building, skip tracing, contact enrichment, phone type verification, and Do Not Call and litigator scrubbing, supplied through Orata's data gateway. They form part of the Terms of Service, and capitalised words have the meanings given there.
If you connect your own account with a data provider instead, these terms do not apply to that account. Your agreement with that provider does.
1. Where the data comes from
Data Services draw on licensed third-party data providers, public records and other sources (the Data Providers). Orata does not create this data. Data Providers may change their coverage, sources, prices and terms. We may change the Data Providers we use at any time without notice, provided the Data Services stay materially similar.
2. Credits and charges
2.1 Data Services are charged in credits or per record, at the prices in your Order Form or our current price list. The Service shows the estimated cost of each request before you confirm it, and you or your AI assistant must confirm before any credits are used.
2.2 Unless the price list says otherwise:
- skip tracing is charged only for records where at least one contact point is returned;
- scrubbing and verification are charged per phone number checked, whatever the result; and
- property search is charged per record returned.
2.3 Credits included in a plan are for that billing period and do not roll over. Purchased credit packs expire 12 months after purchase. Credits have no cash value, cannot be transferred, and are not refundable except where the law requires or we have charged you in error.
2.4 To save you money, the Service may reuse a recent result for the same owner or number rather than buying it again. A reused result may be up to 90 days old, and it is charged at the reduced rate shown in the price list.
3. Permitted use
You may use data obtained through Data Services only:
- for your own business of buying, selling, leasing or investing in real estate, and the related marketing and communications; and
- in line with these terms, the Acceptable Use Policy, the Messaging and Calling Policy and applicable law.
4. Prohibited use
You must not:
- resell, sublicense, publish, share or otherwise make the data available to anyone outside your business, or use it to build a database or product for others;
- use the data, in whole or in part, as a factor in deciding anyone's eligibility for credit, insurance, employment or housing (including tenant screening), or for any other purpose covered by the Fair Credit Reporting Act. Orata is not a consumer reporting agency, and Data Services are not consumer reports;
- use the data to locate, stalk, harass or harm anyone, or to serve legal process, collect debts or for law-enforcement purposes;
- use the data in breach of the Fair Housing Act or any anti-discrimination law;
- treat a phone number or email address obtained through Data Services as consent to contact that person; or
- combine the data with other data to re-identify a person where a Data Provider has supplied it in de-identified form.
5. Permissible purpose and flow-down terms
Some Data Providers require users to certify a permissible purpose under the Gramm-Leach-Bliley Act or the Driver's Privacy Protection Act, or to accept their own restrictions. By using Data Services you make the certifications shown in the Service at the time of use, and you agree to the Data Provider restrictions that we publish or show to you. Those restrictions prevail over these terms if the two conflict. You must not use Data Services if you cannot truthfully make those certifications.
6. Accuracy
Data from public records and third-party sources is often incomplete, out of date or wrong. A phone number may belong to someone other than the owner, may have been reassigned, or may be on a Do Not Call list that was updated after a scrub. Scrub results are a snapshot at the time of the check. Data Services are provided "as is", and we do not warrant their accuracy, completeness or fitness for any purpose. You must verify information before relying on it, and you remain responsible for checking Do Not Call status and consent before each contact.
7. Suppression and deletion requests
If a person asks you to delete their data or to stop contacting them, you must honour that request across your instance. If a Data Provider or Orata tells you that a record must be deleted or suppressed, for example because the person has opted out with the Data Provider or the law requires it, you must delete or suppress it promptly. The Service may do this automatically.
8. How Orata handles the data
Data returned by Data Services is delivered to your instance and stored in your Customer Infrastructure. Orata's data gateway keeps request records, billing records and, where section 2.4 applies, cached results for up to 90 days. It does not keep a separate copy of your lists. We process the personal data in requests and results as your processor under the Data Processing Addendum.
9. Suspension
We may suspend Data Services immediately if a Data Provider requires it, if we reasonably suspect a breach of these terms, or if we see unusual usage that suggests a compromised account. Where practical we will tell you why.
10. Liability and indemnity
Data Services are part of the Service for the limits of liability in the Terms. Your indemnity in the Terms covers any claim that arises from your use of data obtained through Data Services.
